二、 投標(biāo)人的資格要求

Performance and Qualification Requirements：

1. 投標(biāo)人應(yīng)當(dāng)是在中華人民共和國(guó)境內(nèi)合法登記注冊(cè)，具有相應(yīng)的經(jīng)營(yíng)范圍,注冊(cè)資金不少于500萬(wàn)人民幣。

2. 投標(biāo)人必須在法律和財(cái)務(wù)上完全獨(dú)立、遵照相關(guān)法律要求開展運(yùn)營(yíng)活動(dòng)、而且不是招標(biāo)代理機(jī)構(gòu)和招標(biāo)人的關(guān)聯(lián)機(jī)構(gòu)，才可以參與本次投標(biāo)。

3. 投標(biāo)人必須有良好的、法律所要求的完稅和社保基金支付記錄。

4. 在過去3年參與政府采購(gòu)項(xiàng)目的業(yè)務(wù)活動(dòng)中，不存在任何嚴(yán)重違規(guī)記錄。

5. 投標(biāo)人必須通過ISO9001質(zhì)量管理體系及ISO14001環(huán)境管理體系的認(rèn)證。

6. 投標(biāo)人提供的產(chǎn)品必須是低VOC或不含VOC的產(chǎn)品。產(chǎn)品必須達(dá)到綠色衛(wèi)士（Greenguard）或同類認(rèn)證標(biāo)準(zhǔn)的要求，部件必須可回收再利用。油漆和所提供的材料（基材、飾面板、紡織品等）必須是VOC含量極低或不含VOC的產(chǎn)品，木材必須取材于控制中的森林資源，而紡織品則應(yīng)當(dāng)至少含有50%的可回收成分。如果客戶提出LEED認(rèn)證要求，則產(chǎn)品本身必須達(dá)到這一要求，不需要增加額外工作或費(fèi)用。

7. 投標(biāo)人必須提供一份其在過去5年內(nèi)參與的相關(guān)項(xiàng)目清單（大學(xué)/院校、辦公樓、外商獨(dú)資企業(yè)），清單上每個(gè)項(xiàng)目的總金額都應(yīng)當(dāng)不小于100萬(wàn)人民幣。清單上應(yīng)當(dāng)注明這些相關(guān)項(xiàng)目的聯(lián)系人和資料，便于上海紐約大學(xué)聯(lián)系并了解投標(biāo)人在項(xiàng)目開展過程中的具體表現(xiàn)。

8. 投標(biāo)人在上海有固定的售后服務(wù)團(tuán)隊(duì)以及能夠提供專業(yè)的售后服務(wù)。

9. 投標(biāo)人必須配備必要的設(shè)備、具備專業(yè)的技術(shù)能力。投標(biāo)人應(yīng)當(dāng)，而且必須通過其員工或分包商，展現(xiàn)出其能夠完成其產(chǎn)品安裝任務(wù)的專業(yè)能力。如果投標(biāo)人委托了分包商，則應(yīng)當(dāng)提供分包商的資料（包括名稱、地址、聯(lián)系人和具體信息），并提供過去5年分包商為投標(biāo)人完成的所有項(xiàng)目列表。

10. 如果部分產(chǎn)品不是由投標(biāo)人制造的，則投標(biāo)人必須提供生產(chǎn)廠家出具的根據(jù)本項(xiàng)目的唯一授權(quán)函及保修和售后服務(wù)的合法證明。

11. 投標(biāo)人所提供的貨物和服務(wù)，不應(yīng)當(dāng)侵犯任何第三方的工業(yè)或知識(shí)產(chǎn)權(quán)，也不得引發(fā)任何針對(duì)此類侵權(quán)的索償。

12. 投標(biāo)人必須遵守中華人民共和國(guó)各類法律、標(biāo)準(zhǔn)、規(guī)章和規(guī)范文件的要求。

13. 投標(biāo)人不應(yīng)當(dāng)發(fā)生任何與招標(biāo)人或其母公司、附屬或聯(lián)營(yíng)公司有關(guān)聯(lián)的商業(yè)賄賂行為，而且不應(yīng)當(dāng)出現(xiàn)在限制或禁用商業(yè)伙伴的名單中。

1. Unless otherwise provided hereafter, any Bidder that has registered legally within the territory of the People’s Republic of China with RMB 5 million registered capital at the minimum that is capable of providing the goods and services under this invitation for bids is eligible for bidding after acquiring the bidding documents directly from the Tendering Agent.

2. The Bidders may participate in the bids only if they are legally and financially autonomous, if they operate under relevant law, and if they are not a dependent agency of the Tendering Agent and the Tenderer.

3. Bidders should have a good record of paying taxes and social security funds according to the law.

4. No record of serious violations in business activities for the past 3 years when engaged in government procurement procedures.

5. The Bidder has passed ISO9001 Quality Management System certification and ISO14001 Environmental Management System certification.

6. The products supplied by the Bidder shall be low VOC or VOC free. Products shall meet Greenguard or equivalent recognized certification and components shall be recyclable. Paints and all materials provided (substrates, veneers, textiles and other) shall be no or extremely low VOC, wood shall be from managed forest resources and textiles shall contain a minimum of 50% recycled content. Products shall qualify for LEED credits with no additional work or cost if client determines this as a requirement.

7. Bidders will provide a list of their experience with related projects in the past 5 years (universities/schools, office buildings, WOFEs) where each individual project’s total value is no less than RMB 1 million. The list shall include contact person and information at these related projects, so that NYU Shanghai can contact and obtain relevant information about the Bidder’s performance.

8. Bidders should have regular after sale service team based in Shanghai and can provide professional service in a timely fashion (24-48 hours) upon requests.

9. Bidders need to perform with necessary equipment and professional technical ability. Bidders shall be responsible for and must demonstrate their ability to provide a professional installation of their products, using their own employees or subcontractors. If they are using subcontractors, they must supply information about the subcontractor (including, name, address, contact person and information), and list all projects that the subcontractor has worked on for Bidder in the last 5 years.

10. If parts of the products are not made by the bidders, it obligates the bidder to provide the manufacturers unique authorization for this project as well as the legal certificate on warranty and after sale service.

11. The goods and services provided by Bidders shall not infringe any industrial or intellectual property right of any third party or incur any claim due to such infringement.

12. Bidders shall comply with the laws, regulations, rules and regulatory documents of the People’s Republic of China.

13. Bidders shall not have any act of commercial bribery involving the Tenderer, or its parent, or any subsidiary or associate, and are not in the list of restricted or prohibited trading partners.
